Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, its business activity has been suspended, or it is in a similar situation. Exclusion also applies if the bidder has outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred or paid. In addition, none of the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act may apply, and the bidder must confirm that its employees’ average salary has not been below 70% of the sector average for the same period. The bidder must also confirm that it is not a related party to the beneficiary’s technical consultant. If the check cannot be carried out through public registers, the relevant evidence must be submitted. In a joint bid, these requirements apply to all joint bidders.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities so that the business activity notice covers general construction, indoor climate systems, and on-site or adjoining water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction and installation of electrical installations. The registration requirement does not apply to a foreign bidder, but it must provide an equivalent proof of competence if needed. The bidder’s net turnover for the financial year preceding the bid submission must be at least equal to twice the estimated contract value excluding VAT. The bidder must provide details of at least one equivalent construction project carried out within the last 60 months, with a value of at least half of the estimated contract value; the equivalent project must have been building erection, extension or full-building reconstruction as the main contractor and must have included at least load-bearing and external envelope works, construction or reconstruction of a heat-recovery ventilation system, and construction or reconstruction of a heating system. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The project manager must have at least a level 6 construction engineer qualification or a level 6 construction manager qualification; the site manager must have a level 5 construction foreman qualification; the ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification; the water supply and sewerage systems specialist must have at least the relevant level 6 engineer qualification or a level 6 construction manager qualification; and electrical works require at least a Class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The bidder must also provide a construction-period security equal to 5% of the contract value excluding VAT, and joint bidders may satisfy this requirement together. The bid must be unconditional and comply with all tender document requirements.
