Compliance requirements
The bidder is excluded if it is bankrupt or being liquidated, if bankruptcy or liquidation proceedings have been opened against it, or if its business activity has been suspended. Exclusion also applies if the bidder has outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts, unless these have been deferred or paid within the required deadline. In addition, none of the grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act may apply, and the bidder and the technical consultant advising the apartment building reconstruction for the beneficiary must not be related persons. The bidder must submit the relevant confirmations and, where necessary, Tax and Customs Board certificates or other required evidence.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general building works, indoor climate systems, and water supply or sewerage systems within buildings or attached to buildings. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations; for a foreign bidder, an equivalent proof may be accepted. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The bidder must be able to provide, for the construction period, a first-demand guarantee letter or equivalent security in the amount of 5% of the construction contract value excluding VAT. During the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value; equivalent work means erection, extension or full reconstruction of a building as the main contractor, including load-bearing structures and external envelope works, heat-recovery ventilation, and heating system construction or reconstruction. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required electrical competence. A joint tender power of attorney, the tender price in the required form, trade secret marking, and confirmation that the tender complies with the procurement documents are also required.
