Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory board members, procurators or other authorised representatives have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The bidder must also confirm that taxes and social security contributions have been paid, or that the relevant information is electronically available. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.

Qualification criteria and exclusion grounds

The tender must comply with all requirements set out in the procurement documents and compliance conditions. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bid must be submitted using the required forms: bidder declaration, price form and, where applicable, a trade secret explanation. Conditional bids are not allowed. The bid price must be entered according to the structure on the worksheet ‘Award criteria and evaluated indicators’, and if the price form and the data entered in RHR differ, the contracting authority will rely on the price form. For paper products, where required, the bidder must prove that the primary wood fibre used for cellulose comes from a legal source and provide an EU Ecolabel or an equivalent EN ISO 14024 Type I ecolabel, or, if absent, a conformity audit. The bidder must also confirm that the offered goods are not subject to international sanctions and that subcontractors, suppliers or relied-on entities subject to Russian sanctions are not involved for more than 10% of the contract value.
