Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder: participation in a criminal organisation, breach of duty of integrity or a corrupt act, fraud, a terrorist offence or another terrorism-related offence, money laundering or terrorist financing; enabling the employment of a foreign national staying in the country without legal basis or violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of the bidder’s country of establishment; or a breach of an international sanction or a sanction of the Government of the Republic.
The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder and/or its subcontractor must have performed at least 1 similar contract completed within the 36 months before the start of the procurement, where the subject was a building audit and/or expert assessment. A list of contracts must be submitted with information on the contract value, dates and the other contracting parties.
Among the persons responsible for carrying out the work there must be at least one audit performer who holds the professional qualification of chartered civil engineer at least level 7 and the competence “Building audit” or equivalent or better. There must also be at least one audit performer who holds the professional qualification of chartered civil engineer at least level 7 and the competence “Preparation of building design documentation” or “Design management” or equivalent or better.
The bidder must submit copies of documents proving the qualifications and competence of the responsible persons. A foreign bidder that does not have such documents issued in Estonia must submit copies of the documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
The bid must comply with the procurement documents and conditional bids are not allowed. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The completed bid price form must also be submitted and the total amount from it must be transferred to the relevant bid form.
