Compliance requirements
The bidder, or a member of its management, supervisory or representative body, must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD, unless the disqualification period in the judgment has already expired. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm payment of taxes and social security contributions, or provide information that allows the contracting authority to verify this directly from a free database. The bid will be rejected if it is conditional or if the offered goods are subject to international sanctions or originate from a sanctioned area.
Qualification criteria and exclusion grounds
The bidder must involve an owner’s supervision representative for performance of the contract, and that person must participate personally in the contract execution. The minimum requirement is a level 7 certified water supply and sewerage engineer qualification (not initial level), specialising in external water supply and sewerage and in the field of owner’s supervision, or an equivalent professional qualification. An equivalent qualification obtained in another country is accepted. For an Estonian bidder, the contracting authority will check the validity of the professional certificate in the professional register; for a foreign certificate, the bidder must be ready to submit copies of the documents proving the qualification if requested. The bid must comply with the requirements in the procurement documents and, where necessary, include evidence explaining equivalence. The bid price must be submitted according to the prescribed structure. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. If subcontracting is used, the bidder must indicate the names of the planned subcontractors and the size and nature of the part of the contract to be subcontracted; by the start of performance, the bidder must also provide the known subcontractors’ contact details and information about their legal representatives. Only bidders established in Estonia, another EU Member State, another EEA contracting state or a country that has acceded to the WTO Government Procurement Agreement may participate.
