Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking, and the other statutory exclusion grounds set out in the tender documents. If an exclusion ground applies, the bidder may need to show self-cleaning measures where allowed. The machine-readable notice did not include the full list of precise exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or a similar register in its country of establishment. For an Estonian bidder, the contracting authority checks the registration itself through the register, but a foreign bidder must provide, on request, a copy of the document proving registration. The person submitting the tender must have the right to represent the bidder; if this is not evident from the commercial register, a power of attorney must be attached. In the case of a joint tender, a power of attorney for the joint bidders and a confirmation of joint and several liability must be submitted. The bidder must also provide a confirmation that the tender complies with the tender conditions and a description of the goods offered with enough detail for the contracting authority to verify compliance with the technical specification, delivery time and warranty period. If the bidder is not the manufacturer, it must provide evidence of the right to resell the goods and to carry out post-warranty maintenance. The machine-readable notice did not include more precise qualification or compliance requirements; the rest must be checked in the tender documents.
