Compliance requirements

The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or if its business activity is suspended, or if it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has tax, fee, environmental charge, social security or similar payment arrears, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving the relevant notice. The notice also requires confirmation that the bidder has no exclusion grounds under the Public Procurement Act provisions referred to in the documents, and that the bidder is not a related person to the technical consultant advising the grant recipient on apartment building reconstruction. If the bidder is a consortium, the exclusion grounds apply to all consortium members where at least one member has a relevant ground.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but the bidder must provide equivalent proof of competence if needed. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest EUR 1. The bidder must prove that within the 60 months before the start of the procurement procedure it has carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full reconstruction of a building as the main contractor and must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and the heating system. For the project, the bidder must provide the project name, building details, execution period, value, and proof by means of a use notice, building permit or handover-acceptance certificate. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The required professional certificates or equivalent competence documents must be provided. If the bidder relies on the capacities of other persons, signed confirmations of their participation in contract performance must be attached. The machine-readable notice did not include precise compliance requirements beyond the documents and confirmations mentioned above; these must be checked in the official tender documents and tender documents. The bid must be unconditional and the bidder must confirm that it accepts all tender document conditions and that the bid complies with them. The bid price must be submitted in the structure required in the tender documents, and a bid form must be completed and attached. If the bid is a consortium bid, a power of attorney for the consortium members must be included. The bidder must also state any business secret in the bid and explain why it is treated as a business secret.
