Compliance requirements

The bidder must not have the exclusion grounds listed in the Estonian Public Procurement Act § 95(1) points 1–5 and § 95(4) point 12. The bidder must confirm this in the procurement register. If the bidder has other persons in the company who may represent, decide on behalf of, or control the company and who are not visible in the commercial register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist. If a foreign bidder or a foreign subcontractor participates, supporting documents proving the absence of the exclusion grounds must be added for the foreign entity and its relevant management or representative persons.

Qualification criteria and exclusion grounds

The bidder’s total net turnover from all business activities in each of the last three completed financial years must be at least EUR 150,000 per year. If the bidder relies on another company’s resources to prove turnover, the bidder must submit that company’s consent and state to what extent the bidder may rely on its turnover. In a joint bid, the share and nature of each joint bidder’s part of the contract must be provided. The bid must comply with all conditions set out in the procurement documents, be signed by the legal representative or an authorised person, and a power of attorney must be attached if applicable. The bid price must be submitted in the structure required by the contracting authority, and the bid price table must be attached. Where relevant, equivalence must be explained and supporting evidence must be provided. The bidder must also confirm environmentally sustainable performance, separate waste collection and recycling, and, where possible, the use of environmentally friendly equipment.
