Compliance requirements
The bidder and its representatives must not have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, financing terrorism, money laundering, child labour or other forms of human trafficking. If such a ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted.
The tender documents also contain other standard exclusion grounds, but the machine-readable notice did not set them out precisely; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must show an annual turnover of at least EUR 300,000 in each of the last three financial years completed before the start of the procurement. If the data are not available from a public database, the contracting authority may request the last three annual accounts, extracts or other appropriate evidence.
The bidder must have properly performed at least 2 similar contracts in the 36 months before the start of the procurement. Similar contracts are contracts for the design, installation and rental/lease of modular buildings or modular building sections, each with a closed net floor area of at least 500 m2.
The bidder must confirm that it has a business activity notice or a corresponding registration or licence for the construction activity in the MTR register, or an equivalent registration/licence under the law of the country of establishment. If the bidder relies on a subcontractor, the person whose registration is relied upon must personally perform the relevant part of the contract.
The bidder must involve at least one chartered civil engineer level 7 as project manager and at least one chartered architect level 7 as architect. The names and certificate numbers of these specialists must be provided.
The bid must comply with the tender documents and conditional bids are not allowed. If an equivalent solution is offered, its equivalence must be proven with the manufacturer’s technical file, test report, declarations or certificates. The bid price must be submitted in the required structure and with two decimal places.
