Compliance requirements
The bidder must confirm that none of its managers, legal representatives or supervisory board members, or other persons authorised to represent, decide for or control the bidder, has been finally convicted within the last five years for the listed exclusion grounds such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the other mandatory exclusion grounds set out in the tender passport. If an exclusion ground exists, the bidder may have to show self-cleaning measures where allowed. Qualification criteria and exclusion grounds
The bidder must be registered as a food business operator with the relevant authority or information system in its country of establishment. For an Estonian bidder, the registration must cover at least one of the following areas: retail trade, including the preparation of food for direct sale to consumers or to other operators; handling of non-animal and mixed food; or wholesale trade, meaning storage of food not produced by the bidder for sale to another operator. A foreign bidder must submit a standard confirmation and, on request, the required documents. In addition, the annual turnover for each of the last three years must be at least EUR 60,000. When submitting the tender, the bidder must confirm that the tender complies with the procurement documents, complete the required price table and attach Annex 1, “quantities, descriptions and price table”. In the case of a joint tender, a power of attorney from the joint bidders must be submitted. If the tender is submitted by a person who is not a board member listed in the commercial register, a power of attorney must be provided.
