Compliance requirements

The bidder and its management body members must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or offences related to the commission of a terrorist act or terrorist activity. If such a ground exists, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice also refers to other exclusion grounds under the Public Procurement Act, but the exact list must be checked in the procurement documents.

Qualification criteria and exclusion grounds

The bidder must have at least 1 properly completed contract within the last 36 months before the publication of the contract notice for preparing a feasibility and profitability analysis, a sector strategy, or a sector development concept. The bidder must provide contract details: a short description, total amount, the bidder’s scope of responsibility, the performance period, the contracting authority’s name, the contact person’s name, email, phone number, and the public procurement reference number if the contract was awarded through public procurement. The contracting authority may request evidence of proper performance. The person submitting the tender must have the right to represent the bidder; if this is not shown in the register, a power of attorney must be attached. In the case of a joint tender, an authorised representative must be named and a joint power of attorney must be attached. The tender must comply with the procurement documents, conditional tenders are not allowed, and equivalence must be explained and supported by evidence where relevant. The bidder must also confirm that the tender price is submitted in the required structure and indicate whether the tender contains trade secrets.
