Compliance requirements
Mandatory exclusion grounds include, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering and terrorist financing, illegal employment of foreign workers, offences related to child labour or human trafficking, tax debts, and breach of sanctions. Voluntary exclusion grounds include serious or repeated breaches of previous public contracts and the submission of false information or failure to submit required documents. The bidder must confirm that none of these grounds apply to it or to the members of its management bodies. The bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have a person managing electrical works with a valid A-competence certificate or at least a level 6 qualification under the Vocational Education Institutions Act, and must provide the relevant proof at the time of submitting the tender. If the bidder is not established in Estonia, it must submit confirmations and documents proving equivalent competence or an electrical engineer professional qualification. The tender must include Form 1, the price schedule, fully completed; positions or quantities may not be changed, and the tender price must be stated in euros excluding VAT. The bidder must provide the name(s), job title(s) and contact details of the person(s) signing the contract, as well as the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. In the case of a joint tender, an authorised representative must be named and a joint bidders’ power of attorney must be attached. The bidder must confirm that the tender complies with the procurement documents, and conditional tenders are not allowed.
