Compliance requirements
Mandatory exclusion grounds include, among other things, conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; labour-law related offences; offences involving illegal use of child labour or human trafficking; tax, duty or environmental charge arrears; and any situation where awarding the contract would breach an international sanction or a Government of the Republic sanction. The contracting authority may also exclude a bidder that has seriously or repeatedly breached previous public contracts or has submitted false information about qualification or failed to provide required documents. The bidder must confirm that none of these grounds apply to it or its representatives.
Qualification criteria and exclusion grounds
The bidder must have a person managing electrical works with valid A-competence and/or at least level 6 qualification under the Occupational Qualifications Act, with the relevant proof available at the time of submission. If the bidder is not established in Estonia, it must provide confirmations and documents proving equivalent competence or an equivalent electrical engineer professional qualification. In addition, the bidder must submit the certificate of the person declared with A-competence or an equivalent electrical engineer professional qualification. Under the compliance requirements, the bidder must also submit Price Schedule Form 1, complete all mandatory fields, and not change any items or quantities. The bidder must ensure that one or more designated C-persons responsible for the work execution are assigned, provide the contract signatory(ies) and contact person details, and, where necessary, a power of attorney. In a joint bid, an authorised representative must be appointed and the joint bidders’ power of attorney must be attached. The bid must be submitted as full acceptance of the tender documents; conditional bids are not allowed.
