Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the notice apply, including the grounds under section 95(1) points 1–3 and 5 of the Public Procurement Act, taking into account section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been opened against it, its business has not been suspended, and it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, or social security contribution debt under the law of its country of establishment. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. In a joint tender, each joint bidder is treated as a bidder and the checks apply to all joint bidders. The notice also requires proof from the Tax and Customs Board extract that the average salary of the bidder’s employees during the reference period was above 70% of the average salary in the relevant sector; foreign bidders must provide equivalent evidence from a competent authority in their country of establishment.
Qualification criteria and exclusion grounds
The bidder must be registered in the construction activity register for general building works, indoor climate systems, and indoor or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration entry for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but such bidder must prove its competence with an equivalent document.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest 1 euro.
The bidder must be able to provide, no later than the contract date or within 10 calendar days after contract signature, a performance-time security confirmed by a credit or financial institution in the amount of 5% of the contract value. The security must remain valid throughout the construction period. Instead of a guarantee, the relevant amount may be deposited to the beneficiary’s bank account or with a notary, provided that the beneficiary remains the entitled party throughout the construction period.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the construction, extension, or full-building reconstruction of a building as the main contractor, including at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. To prove this, the bidder must provide the project name, timing, value, information on the nature of the work, and a reference to the occupancy notice or occupancy permit number, or a copy of the handover-acceptance certificate.
The team must include a project manager with at least level 6 professional qualification as a construction engineer specialising in building construction, or level 6 construction manager qualification specialising in general building works. There must also be a site manager with at least level 5 construction foreman qualification specialising in general building works. In addition, the team must include a ventilation and heating systems specialist with at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or level 6 construction manager qualification specialising in indoor climate systems. A water supply and sewerage systems specialist is also required, with at least level 6 qualification as a water supply and sewerage engineer or level 6 construction manager qualification with the relevant specialisation. For electrical works, the team must include a person with at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. The name and professional or competence certificate number of each such person must be provided; an equivalent qualification is acceptable for foreign bidders.
The bidder must have a quality management system in the construction field that complies at least with EVS-EN ISO 9001 and an environmental management system that complies at least with EVS-EN ISO 14001, or equivalent conditions.
