Compliance requirements

The machine-readable notice included exclusion grounds confirmations, but the exact legal wording and control procedure are set out in the tender documents. The bidder must confirm that none of the exclusion grounds under the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened and business is not suspended, that it has no tax, fee or social security debt under the law of its country of establishment, and that it is not linked to the technical consultant advising on the apartment building reconstruction. For joint bids, each joint bidder is treated as a bidder and the checks apply to all joint bidders.

Qualification criteria and exclusion grounds

The bidder must be registered in the construction activity area with the activity types of general construction, indoor climate systems, and building-internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but the bidder must provide an equivalent proof of competence where applicable. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In addition, the bidder must confirm that it can provide a performance-period guarantee amounting to 5% of the contract value by the contract signing date at the latest, or within 10 calendar days after signing. The guarantee must remain valid throughout the construction period; depositing the corresponding amount into the beneficiary’s bank account or a notary account is also acceptable if the beneficiary remains the entitled party throughout the construction period. Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project must be the construction, extension, or full-building reconstruction of a building as the main contractor and must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a new heating system. For the project, the bidder must provide the project name, building details, execution time, value excluding VAT, and proof by means of a use notice, occupancy permit, or handover-acceptance report. The team must include a project manager with at least a level 6 construction engineer qualification specialising in building construction or a level 6 construction manager qualification specialising in general construction. There must also be a site manager with at least a level 5 construction work manager qualification specialising in general construction works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or a level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialisation. For electrical works, the involved person must have at least a Class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The name and qualification or competence certificate number of each such person must be provided, and they must be involved in the execution of the works. The bidder must have a quality management system in the construction activity area that complies at least with EVS-EN ISO 9001 and an environmental management system that complies at least with EVS-EN ISO 14001, or equivalent conditions.
