Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies, its proxies, or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. For subcontractors, the first-tier subcontractors are checked during contract performance against the same criminal exclusion grounds.
Qualification criteria and exclusion grounds
The bidder’s average net turnover for the last three completed financial years must be at least EUR 1,000,000 per year for the period 01/01/2023–31/12/2025. The bidder must have completed at least one similar external water pipeline construction contract, or contracts, within the last 60 months, with a total pipeline length of at least 500 m. The bidder must provide the contract details, completion time and the other contracting party’s information, and where relevant the ESPD of the other entity and the subcontractor’s consent. The works must involve a responsible specialist with a professional qualification of water supply and sewerage construction manager level 6, specialising in external water supply and sewerage, or equivalent, and at least one contract performance experience in external water supply or sewerage works. The bidder must submit the specialist’s CV, a copy of the qualification document if the data are not easily available from a public register, and the specialist’s written consent to participate in contract performance. The bidder must have a construction activity registration for the specific category of water supply and sewerage construction, or equivalent; if relying on a subcontractor, the subcontractor’s details, consent and confirmation must also be provided. The tender must be final, include all costs of contract performance and comply with the tender documents. The bidder must provide the legal or authorised representative details, a power of attorney if the tender is submitted by an authorised person, a joint tender power of attorney and joint liability confirmation in case of a joint tender, subcontractor details and consent, a trade secret designation, and bidder confirmations of acceptance of the tender conditions. The machine-readable notice did not include precise compliance requirements; these must be checked in the tender documents.
