Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, or for any other exclusion grounds stated in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The bidder must also confirm that, for contract performance, it will not use subcontractors or suppliers representing more than 10% of the contract value if they are Russian citizens, residents, or entities established in the Russian Federation, or persons linked to them. In the case of a joint tender, a authorised representative must be appointed and the joint tender power of attorney must be attached. The bidder must confirm that the tender complies with the procurement documents and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
Qualification criteria and exclusion grounds
The bidder must have experience in providing rental services for similar portable toilets and/or hand-washing stations together with related services such as transport, installation and interim servicing. Sufficient experience means that the bidder has properly performed at least 3 contracts or orders during the 36 months before the start of the procurement, with the subject being the rental of similar portable toilets and/or hand-washing stations together with related services. The experience must be proven through the confirmation and data provided in the ESPD. No additional documents need to be submitted with the tender, but the contracting authority may later verify performance of the contracts or transactions from the successful bidder. The tender must comply with the procurement documents. Sample offer form I must be completed according to the instructions on the form and submitted as a compliance document. The bidder must also provide the address or addresses of its warehouse(s); the contracting authority prefers at least one warehouse or intermediate warehouse to be located in Estonia, if possible for rapid service delivery.
