Compliance requirements
The bidder must confirm that neither it nor persons with management or representation powers have been convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The ESPD also requires confirmation that taxes and social security contributions have been paid and, where needed, evidence or an electronic reference to that information. In addition, the bidder must confirm that its place of establishment or residence is in Estonia, another EU Member State, an EEA contracting state, or a country that has acceded to the WTO Government Procurement Agreement.
Qualification criteria and exclusion grounds
The bidder must review and confirm the qualification and exclusion conditions set out in the ESPD. The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. Under the compliance conditions, the bidder must confirm that the bid complies with the tender documents and, where necessary, that equivalence has been explained and supporting evidence has been attached. If a joint bid is submitted, a power of attorney from the joint bidders must be attached. If an equivalent product is offered, the bidder must provide a comparison table or other evidence, the manufacturer’s technical file, test reports, declarations or certificates showing compliance with the technical specification.
