Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the tender passport. If an exclusion ground applies, the bidder may have to provide evidence of self-cleaning where allowed. Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by the laws of that country. An Estonian bidder does not have to submit a copy of the registration certificate, although the contracting authority may request it. If the bidder relies on the resources of another company, the details of that entity and, where necessary, its consents must also be provided.
For technical and professional capacity, the bidder must prove that during the 36 months preceding the start of the procurement it has performed at least one contract worth at least EUR 200,000 excluding VAT and covering similar work, namely rail grinding on main lines of public railway lines. Alternatively, the requirement is met if the bidder is a public railway infrastructure company that owns or is authorised to use a rail grinding machine and has used it to grind at least 150 km of railway during the same period.
For contract performance, the team must include at least two rail grinding service specialists who together have at least 1 year of rail grinding service experience during the 36 months preceding the start of the procurement. If a team member is not an employee of the bidder, confirmations of the absence of exclusion grounds and willingness to participate in contract performance must also be submitted. In addition, a service schedule, the tender price in euros and, where applicable, an explanation and evidence of equivalence must be provided. The tender must comply with all tender document requirements and conditional tenders are not allowed.
