Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other authorised representatives have, within the last five years, been finally convicted for participation in a criminal organisation, corruption, fraud, terrorist offences or other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning where permitted. The notice also includes sanctions-related confirmations: the bidder must confirm that it will not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value, and that the offered goods are not the object of international sanctions and do not originate from sanctioned areas.

Qualification criteria and exclusion grounds

The bidder must have performed at least 1 catering services contract within the last 36 months, with a duration of at least 12 months, whose subject was the provision of school lunches in a school for at least 100 pupils or school staff. To prove this, the bidder must submit a list of completed contracts with the contracting partner’s name and contact details, a description of the contract subject, the number of meals served, the contract award and performance dates, the contract period, and, in the case of a public contract, the reference number. If the contract was performed only partly within the reference period, only the part that had been delivered and accepted by that time counts. As compliance requirements, the bidder must confirm that the tender complies with all tender document requirements, that no conditional tender has been submitted, and must provide the required annexes, including the school food cost breakdown form and the sample menu. In the case of a joint tender, a power of attorney from the joint bidders must be attached. The bidder must also confirm that subcontractors and suppliers used in performance are established or resident in permitted countries, and that any business secret is marked only within the allowed scope.
