Compliance requirements
The exclusion grounds are set out in the ESPD and include at least participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking. The ESPD also asks whether the bidder or members of its management body have been finally convicted of these offences within the last five years and whether self-cleaning measures have been taken. The exact exclusion grounds and any possible self-cleaning or remediation options must be checked in the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents. As compliance requirements, the bidder must confirm that the bid complies with all tender document requirements, submit the joint bidders’ power of attorney on Appendix 5 if applicable, complete Appendix 2 for the bid price in euros excluding VAT, and inspect the site before submitting the bid. If subcontracting is used, Appendix 3 and a signed Appendix 3a confirmation must be submitted for each subcontractor. The contracting authority also checks subcontractor exclusion grounds and may require replacement if a subcontractor is subject to an exclusion ground.
