Compliance requirements
The machine-readable notice includes standard exclusion grounds such as participation in a criminal organisation, corruption, fraud and other mandatory grounds from the ESPD. If an exclusion ground applies, the bidder may be able to provide evidence of self-cleaning, where allowed by law or the tender documents. The exact exclusion grounds and any recovery/self-cleaning details must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must hold an activity licence entered in the Register of Economic Activities for handling stationary refrigeration and air-conditioning equipment and heat pumps containing fluorinated greenhouse gases. The contracting authority will check this in the register itself.
The bidder’s net turnover over the last three financial years must be at least EUR 400,000 for each year, i.e. at least EUR 1,200,000 in total. The bidder must provide a confirmation and an extract of its net turnover for the last three years; for a legal entity registered in Estonia, the contracting authority may check the data directly from the register.
The bidder must have a valid professional liability insurance policy or a written commitment that it will take out insurance for the full contract period in the amount of at least EUR 300,000 per year.
The bidder or its subcontractor must have at least two employees who perform repair and maintenance work on cooling equipment. The first employee must have at least the qualification “Refrigeration mechanic, level 4” or equivalent. The second employee must have completed a higher education, applied higher education or vocational programme in refrigeration; or a programme in thermal engineering or electrical engineering; or have at least basic education, training in handling refrigeration and air-conditioning equipment or heat pumps and leak prevention, and at least one year of practical work experience. The exact experience requirement for the second employee is partly truncated in the machine-readable text, so it must be checked in the official tender documents.
The bidder must also provide a written confirmation from the equipment manufacturer or importer that it is authorised to carry out repair and maintenance work on Daikin, Rittal, Mitsubishi, York and Blue Box equipment. In addition, written consents must be submitted for all natural persons named in the bid whose data are used to prove compliance with the qualification requirements, allowing them to participate in contract performance and for their personal data to be processed for the procurement procedure and contract award.
