Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in section 95(1)(1–5) and 95(4)(12) of the Public Procurement Act apply. If there are other persons in the bidder’s company who may represent, decide for, or control the company and who are not visible from the business register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the publication deadline of the contract notice, at least one completed contract under which it carried out the design of at least one publicly used road, highway or street. The reference contract must have a value of at least EUR 20,000 excluding VAT, and a use permit for the designed road, highway or street must have been issued by the publication deadline. The bidder must submit the reference contract details on the contracting authority’s form (Annex 3).
If the bidder relies on another company’s resources to prove technical and professional capacity, it must submit that company’s consent on the form in Annex 5. In that case, the other company must confirm that it agrees to the bidder relying on its indicators and that it will take part in direct performance of the contract to the extent relied on. If the bidder relies on a contract performed by another company, that company is treated as a subcontractor and the subcontractor must be added to the offer, with the relevant confirmation marked in the register. If joint bidders rely on each other’s resources, the offer must state the size and nature of each joint bidder’s share of the contract, using Annex 6 if needed.
The person responsible for the design works must have at least the equivalent of level 7 certified road engineer qualification with specialisation in roads and competence in design management. If the professional standard is no longer valid, the responsible person must meet the new equivalent standard. The bidder must provide the responsible person’s details and, if needed, copies of documents proving the qualification, regardless of whether the person is employed by the bidder or works as a subcontractor.
