Compliance requirements
The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that subcontractors or suppliers representing more than 10% of the contract value are not citizens, residents or entities established in the Russian Federation, and are not controlled by or acting on the instructions of such persons or entities. The machine-readable notice did not include precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit a tender that complies with the technical specification in the procurement documents. The technical specification of the offered solution must allow the contracting authority to verify compliance with all requirements without ambiguity. If the bidder relies on another entity’s capacities to demonstrate economic and financial standing or technical and professional ability, that entity’s consent must be submitted and, where relevant, it must be listed as a subcontractor with a note that its capacities are being relied on. In a joint tender, a power of attorney from the joint bidders must be provided. The tender must include the details of the person signing the contract and the contract contact person, and a power of attorney must be attached if the contract will be signed by an authorised representative. The tender must include the duly completed Annex 2 pricing form, and all prices must be in euros excluding VAT. Where the contracting authority refers to a standard, technical approval, technical control system, trademark, patent or type, equivalence must be shown where necessary and evidence must be attached.
