Compliance requirements
The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences linked to terrorist activity, money laundering or terrorist financing, child labour or other forms of human trafficking. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice listed the exclusion grounds, but any detailed conditions must be checked in the tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment and, where required, provide evidence of registration or registry data. The financial requirement is that the bidder’s total turnover from business activities over the last two completed financial years must be at least EUR 210,000 excluding VAT. If the bidder relies on the capacities of other entities, the necessary information about those entities must also be provided.
For technical and professional capacity, the bidder must have properly performed at least 3 Microsoft licence sales and/or rental contracts during the last 36 months, with each contract having a value of at least EUR 100,000 excluding VAT. If a contract was partly outside the required period, the part performed within the required period must amount to at least EUR 100,000 excluding VAT. For each reference, the bidder must provide the contract name, start and end dates, customer details, contract value, and, in the case of a public contract, the reference number. The contracting authority may request additional documents if the information cannot be checked easily in public databases.
Under the compliance requirements, the bidder must confirm that it accepts the tender document terms, fully agrees with them and does not add any additional conditions. The bidder must also confirm that it has authorised Microsoft LSP partner status and the right to sell Microsoft software, and must provide Microsoft-signed confirmations or other evidence of this.
