The bidder must confirm that neither it nor its management or supervisory body members have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The ESPD also requires confirmation regarding payment of taxes and social security contributions and, where necessary, electronic evidence. Under the compliance requirements, the bidder may not involve subcontractors or suppliers linked to the Russian Federation in the manner described in the regulation for more than 10% of the contract value; otherwise the bid will be rejected.

The machine-readable notice did not include precise selection, suitability or compliance criteria; these must be checked in the tender documents. According to the compliance requirements, the bid must include the duly completed “Annex 3. Specification and price form for the offered goods”, and the offered goods must comply with the technical description. If the contract is signed by an authorised representative, a power of attorney must be attached. The bid must also include the details of the contract signatory and the contact person, and the bidder must confirm that the bid complies with the tender documents. If the bidder relies on equivalence, it must explain this where necessary and attach evidence.
