Compliance requirements
The ESPD contains mandatory exclusion grounds for which the bidder must provide confirmations. These include at least participation in a criminal organisation, corruption and fraud. For each ground, the bidder must confirm whether a final conviction exists within the last five years or whether the exclusion period is still in force. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The exact exclusion grounds and any possible remediation must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the offer in the structure required by the procurement documents and confirm that the offer complies with the requirements. If the offer is a joint bid, a power of attorney from the joint bidders must be attached. If the bidder marks information as a trade secret, it must briefly justify that designation. The bidder must confirm that it has the right to sell the offered licences and product support in the Republic of Estonia and must provide a valid manufacturer confirmation of the sales right and the product support terms. If the sales right is granted for representation of the manufacturer in the European Union or is evidenced through a cooperation partner, that is also considered sufficient. The bidder must also provide the names and personal identification codes of authorised persons, or confirm that there are no such persons. Where relevant, evidence of equivalence must also be provided if the offered solution does not exactly meet the stated requirements.
