Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority also checks exclusion grounds for subcontractors if the bidder relies on their capacity.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last financial years ending before the start of the last three procurement procedures must be at least EUR 70,000 excluding VAT. The turnover information must be provided in the ESPD.
The bidder must have performed at least 2 contracts during the last 5 years, with a total value of at least EUR 70,000 excluding VAT. The bidder must provide the contract values, signing dates, a short description of the contract subject and information about the other contracting party. Customer reference letters may be attached to speed up the process.
If the bidder uses subcontractors and relies on their capacity, a separate ESPD must be submitted for those subcontractors and the share of subcontracted work as a percentage of the total contract value must be stated. The subcontractor’s consent must also be submitted when subcontractors are used.
The bid must be submitted in the required composition, include all required documents and forms, and confirm compliance with the conditions set out in the procurement documents. If the bid is submitted by a person whose right of representation does not arise from law and cannot be verified in public registers, a duly completed power of attorney must be attached. In the case of a joint bid, a power of attorney for the joint bidders must be submitted. The bid price must be provided in the required structure and must include all costs necessary for performing the works.
