Compliance requirements
The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud or other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The contracting authority also checks that subcontractors or suppliers accounting for more than 10% of the contract value are not linked to the Russian Federation in the manner described in the notice. The bidder must confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned territories. If the bid is submitted as a joint tender, a power of attorney for the joint bidders must be attached. The machine-readable notice did not set out all exclusion grounds in full; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must hold a valid licence for the activities of guarding and carrying out security audits for the entire duration of the framework agreement. If the bidder is licensed in an EEA state, it must be entitled to carry out the activity in Estonia in accordance with the Security Activities Act, except in the case of temporary cross-border service provision. The bidder must also have a valid radio frequency licence issued by the Consumer Protection and Technical Regulatory Authority or a registration in the register of economic activities that allows operation of a radio network on the frequencies needed for the security service. Professional liability insurance must be at least EUR 1,000,000 per insured event and at least EUR 1,000,000 as the annual aggregate limit. The successful bidder must have the insurance contract in force no later than before contract signature and it must remain valid for the entire contract performance period. The bid must include the licence numbers, a copy of the radio frequency licence and the insurer’s confirmation or a copy of the policy. For technical capability, a list of similar services or other proof of previous comparable performance must be provided, but the machine-readable notice did not include a precise minimum experience requirement; this must be checked in the tender documents. The bid must also include a description of the security organisation’s management and quality control, a service organisation plan, a description of the patrol control system, and confirmation that the conditions referred to in point 2.17 of the technical specification are met or will be met before performance starts.
