Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply: participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling illegal employment of a foreign national or paying wages below the statutory minimum; illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or social security contribution arrears. The bidder must also confirm that none of the voluntary exclusion grounds apply: a material or repeated breach of a previous public contract that led to withdrawal, termination, price reduction, compensation of damages or payment of a contractual penalty; or providing false information about compliance with selection criteria or failing to submit required documents. In addition, the bidder’s place of establishment or residence must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from the Russian Federation or the Republic of Belarus. The contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts showing the performance period, the other contracting parties and, in public procurements, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed, unless the contracting authority can obtain the information from public or its own databases without major cost. The bidder’s team must include a person with valid switching rights who has been entered into Elektrilevi’s partner portal before the deadline for submitting tenders. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching rights are required; in other cases, both low-voltage and medium-voltage switching rights are required. The bidder must have a person appointed as responsible for the work operation, and that person must be entered into Elektrilevi’s partner portal before the deadline for submitting tenders. The bidder’s team must include an electrical works manager with valid A-competence and/or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, who has the relevant proof at the time of submitting the tender and is entered into Elektrilevi’s partner portal before the deadline. The bidder must provide the names, job titles and contact details of the person(s) signing the contract and the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must include a price table in the format required by the tender documents, and all unit price fields must be completed. The bidder must also take into account the instructions for completing control system document V178.
