Compliance requirements
Mandatory exclusion grounds: the bidder is excluded if it or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control it has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing; if it has been convicted of enabling the employment of a foreign national staying in the country unlawfully or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum wage; if it has been convicted of unlawful use of child labour or trafficking in human beings; or if it has tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment.
Voluntary exclusion grounds: the contracting authority may exclude a bidder if it has seriously or repeatedly breached an essential term of a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were compensated or a contractual penalty was paid; or if it has provided false information about compliance with the selection criteria or failed to submit the required information or additional documents.
The bidder must confirm that none of these exclusion grounds apply. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from Russia or Belarus. The contracting authority may request certificates of origin for verification purposes.
The machine-readable notice did not include any more precise exclusion grounds; they must be checked in the official tender documents or tender documents if needed.
Qualification criteria and exclusion grounds
During the 60 months before the start of the tender, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts, including the performance period, the other contracting party’s details, and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information itself from public or private databases.
The bidder’s team must include an employee with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the deadline for submitting tenders. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching authorisations are sufficient; otherwise both low-voltage and medium-voltage switching authorisations are required.
The bidder must also have a person designated as responsible for the work operation, and that person must be entered into Elektrilevi’s partner portal before the deadline for submitting tenders.
The bidder’s team must include a person with valid A-competence and/or, within the meaning of the Occupational Qualifications Act, a qualification corresponding to at least level 6 for managing electrical works. That person must have the relevant proof at the time of submitting the tender and must be added to Elektrilevi’s partner portal before the deadline for submitting tenders.
The bidder must provide the name, job title and contact details of the person(s) signing the contract, as well as the contact person for matters related to contract performance. If the signing authority does not arise from the articles of association, a power of attorney must be included.
The tender price must be submitted in the table form required by the tender documents, and all unit price fields must be completed.
If the bid is a joint tender, a power of attorney for the joint bidders must be attached.
