Compliance requirements
Mandatory exclusion grounds are as follows: the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or other terrorism-related offence, money laundering or terrorist financing. There must also be no conviction for enabling the employment of a foreign national staying in the country without legal basis, including paying less than the statutory minimum wage, or for unlawful use of child labour or trafficking in human beings. The bidder must not have outstanding state taxes, fees or environmental charges, or tax or social security contribution debts under the law of its country of establishment.
The contracting authority may also exclude a bidder if it has seriously or repeatedly breached essential terms of a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was imposed. Exclusion may also follow from submitting false information about compliance with the qualification requirements or from failing to submit requested additional documents.
The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus. It must also confirm that the materials, equipment and goods used in the works, including components, are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin for this purpose.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information on the other contracting parties, including the client representative’s contact details, and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without major cost.
The bidder must have an employee with valid switching authorisations for work-related switching in the 0.22–20 kV electricity network. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching authorisations are required; in other cases, both low-voltage and medium-voltage switching authorisations are required. This person must be entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must also have a person appointed as responsible for the work operation, and that person must be entered in the EPP environment before the opening of tenders. In addition, the bidder must have an electrical works manager with valid A-level competence or, under the Vocational Education Act, at least level 6 qualification; at the time of submission this person must hold the relevant certificate and must be added to the EPP environment before the opening of tenders.
The bidder must provide the name, job title and contact details of the person signing the contract, as well as the name, job title and contact details of the contact person for contract performance matters. If the right of representation does not arise from the articles of association, a power of attorney must be included.
The bid must include a price table in the form set out in the tender documents, and all unit price fields in the table must be completed. The bidder must also take into account the guidance for implementing management system document V178.
In other respects, the machine-readable notice did not include precise qualification or compliance requirements; these must be checked in the tender documents.
