Compliance requirements
The bidder must confirm that no exclusion grounds under Section 95(1) and (4) of the Estonian Public Procurement Act apply to them. The relevant confirmations also cover the usual exclusion grounds related to criminal convictions, money laundering or terrorist financing, child labour, participation in a criminal organisation, and offences related to terrorist acts or terrorist activities. The bidder must also confirm that they do not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents or official tender details.
Qualification criteria and exclusion grounds
The bidder must have the following key staff: a project manager with at least Road Engineer level 7 professional qualification; a site manager with at least Road Engineer level 6 professional qualification; and a designer for design works with at least Water and Sewerage Engineer level 7 professional qualification. The bidder must provide the names of the key staff and the numbers of their professional certificates.
The team experience requirement is also specified in detail: within the last 5 years (May 2021 to May 2026), the nominated project manager must have acted as project manager on at least two construction works involving at least 1,000 m² of asphalt-surfaced street, road or parking area, and on at least one construction work involving at least 50 m of stormwater or sewer pipeline. Within the last 5 years (May 2021 to May 2026), the nominated site manager must have acted as site manager on at least two construction works involving at least 1,000 m² of asphalt-surfaced street, road or parking area. The bidder must provide an overview of the completed works, their scope and contract references.
A work schedule must also be submitted in weekly breakdown without exact dates. The schedule must take into account the overall deadline of 3 calendar months for construction works and 1 calendar month for processing the occupancy permit documentation, as well as the project stages: design, expert review and construction works. The cost list and tender form must be included with the bid. The bid must comply with the requirements in the tender documents and, where necessary, include explanations and evidence of equivalence.
