The bidder must confirm that none of the exclusion grounds under § 95(1) points 1–5 of the Estonian Public Procurement Act apply to it. These include, among other things, convictions for criminal offences, breaches related to employing foreigners without legal grounds, offences involving child labour or human trafficking, tax or social security debt, and sanctions-related restrictions. If the exact exclusion grounds need to be checked, they must be reviewed in the tender documents.

The bidder must be registered in the business register of its country of establishment or in another similar register if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself; a foreign bidder must submit a copy of a valid registration certificate. The bidder and/or its subcontractor must have performed at least 1 contract similar to the subject of the procurement during the last 3 years before the start of the procurement. A list of the most important contracts completed during the last 3 years must be submitted, including their value, dates and the other contracting parties, using the form ‘List of contracts’. If the exact qualification or suitability requirements need to be checked, they must be reviewed in the tender documents.
