Compliance requirements
The bidder must confirm that neither it nor its legally authorised representatives are subject to any exclusion grounds. These include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, financing of terrorism, enabling illegal employment of a foreign national staying unlawfully, illegal use of child labour, human trafficking, tax debts and sanctions breaches.
The contracting authority may also exclude a bidder if it has previously materially or repeatedly breached essential terms of a public contract or if it has submitted false information about the absence of exclusion grounds or compliance with the selection criteria.
The bidder must submit confirmations of the absence of exclusion grounds on form HD Annex 5. In a joint tender, all joint bidders must submit the confirmations.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU, EEA or WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not need to submit a register certificate if the data are publicly available to the contracting authority.
The bidder must have the operating right needed to provide passenger transport services, namely a community licence. The contracting authority will check this in the MTR; if it cannot be checked there, a copy of the licence must be submitted.
The bidder must submit a list of the vehicles used to provide the service and a certified copy of the vehicle card, i.e. the community licence, if it is not available from the register.
If the bidder relies on the capacities of another undertaking, it must provide details of that entity and also submit that entity’s confirmations on form HD Annex 5.1.
The bidder’s net turnover in the passenger transport sector must have been at least EUR 100,000 excluding VAT in each of the last three financial years ended by the start of the procurement: 2023, 2024 and 2025. If the financial year is not the calendar year, the bidder must provide data for its corresponding financial years.
Within the 36 months before the start of the procurement, the bidder must have performed at least 2 passenger transport contracts, each lasting at least 12 months, without material breaches.
The bidder must submit the participation application, turnover data, completed contract data and any other required forms in the format set out in the procurement documents.
