Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing; conviction for enabling illegal employment or violating the conditions for employing a foreign national; conviction for illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or arrears of taxes or social security contributions under the law of the country of establishment. The bidder must confirm that none of these grounds apply.
Exclusion may also apply if the bidder has previously seriously or repeatedly breached an essential term of a public contract so that the contract was withdrawn or terminated, the price was reduced, damages were compensated or a contractual penalty was paid, or if the bidder has provided false information about qualification or failed to submit required information or documents. The bidder must also confirm the absence of these circumstances.
In addition, the bidder’s place of establishment or residence must not be in the Russian Federation or the Republic of Belarus. During performance of the works, materials, equipment and goods, including components, that are produced in or originate from Russia or Belarus may not be used; the contracting authority may request certificates of origin for verification.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, of which at least one must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details, such as phone number and email address) and, in the case of public procurement, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or private databases without significant cost.
The tender must comply with all conditions set out in the procurement documents and must include the tender price in tabular form according to the prescribed template; all unit price fields must be completed. The bidder must also take into account the instructions for completing management system document V178.
The bidder must have an employee with switching authorisations for switching-related work in the 0.22–20 kV electricity network. If only low-voltage works (0.22–1 kV) are procured, at least low-voltage switching authorisations are required; in other cases, both low-voltage and medium-voltage switching authorisations are required. This person must be entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must also have a person designated as responsible for the work operation, and that person must be entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must have an electrical works manager with a valid A-level competence or, under the Vocational Education Institutions Act, at least level 6 qualification, who has the relevant certificate at the time of submitting the tender and who is entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must provide the name, job title and contact details of the person signing the contract, as well as the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included.
The bidder must confirm whether it chooses the contracting authority’s standard payment term or joins the factoring programme, in which case a 95-calendar-day payment term applies from receipt of the invoice.
