Compliance requirements
The bidder must confirm that none of the exclusion grounds referred to in Section 95(1), Section 95(4)(8) and Section 95(4) of the Public Procurement Act apply. The bidder must also confirm that no other grounds for exclusion from the simplified procurement procedure exist. The contracting authority may verify exclusion grounds in accordance with the procedure laid down by law. In addition, the notice asks whether the company is subject to the contracting authority’s restriction on submitting a tender or request based on the bidder’s country of establishment or residence; a yes/no answer is required, and if applicable an electronic reference, code and issuer must be provided.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the procurement documents. As compliance requirements, the bidder must provide the manufacturer and name of the offered software platform and the completed software description form from section 3.1 of the technical specification. The tender must comply with all requirements in the procurement documents, and conditional tenders are not allowed. If a joint tender is submitted, the joint bidders must be registered, a joint bidder power of attorney must be provided, and all joint bidders must confirm the absence of exclusion grounds. Where relevant, explanations and evidence of equivalence must also be submitted.
