Compliance requirements
Mandatory exclusion grounds include participation in a criminal organisation, corruption and fraud. The bidder must answer yes/no questions on these grounds and, where relevant, provide the date of conviction, the reason, the person convicted, the duration of exclusion and any self-cleaning measures.
The ESPD also contains other standard exclusion grounds, but the machine-readable notice did not set out all precise details; these must be checked in the tender documents. The bidder must also confirm that it will not use subcontractors or suppliers linked to the Russian Federation in the manner described in the sanctions rule for more than 10% of the contract value, and that it will not use subcontractors subject to replacement under section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of its country of establishment. If the register data are not publicly available to the contracting authority, a document proving the registration must be submitted.
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 150,000. Joint bidders may aggregate turnover.
The specialist responsible for organising the construction works, i.e. the project manager, must hold the professional qualification of Road Engineer, level 6, with specialisation in road construction and maintenance and the selected competence of managing construction activities, or an equivalent EQF level 6 qualification. The bidder must provide an initial declaration of compliance and, if requested, a copy of the certificate proving the qualification. The contracting authority may verify the qualification in the professional register.
