Compliance requirements
The ESPD includes standard exclusion grounds, and the bidder must confirm that neither it nor its management body members have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing. The bidder must also confirm that no other statutory exclusion grounds apply, or that self-cleaning measures have been taken where permitted. The exact exclusion grounds and any evidence requirements must be checked in the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. According to the compliance conditions, the bidder must confirm that the tender meets the requirements set out in the procurement documents, conditional tenders are not allowed, and equivalent solutions must be supported by evidence where necessary. If the contracting authority refers to a standard, technical approval, trademark, type, origin or similar reference, it must be understood as “or equivalent”.
