Compliance requirements
The bidder must confirm that neither it nor members of its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering, or terrorist financing. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted.
The machine-readable notice gives the exclusion grounds only in general terms; the exact details and any additional conditions must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. The contracting authority may require proof of registration.
Financial requirement: net turnover in the medical devices sector for the last three completed financial years must be at least EUR 100,000. If the data are not available in the e-environment or the 2025 annual report has not yet been approved, the information must be submitted as a document.
Technical capacity: within the last 36 months, at least 3 completed sales contracts for medical devices or supplies of similar value must be shown. The bidder must provide the contract description, total amount, the bidder’s scope of responsibility, contract amount, period, and customer and contact details, if available and not confidential.
For compliance, the bidder must confirm that the bid meets the requirements in the procurement documents, that equivalence has been explained where necessary, and that supporting evidence has been attached. A detailed proof of compliance with the technical specification and the price breakdown table must also be submitted. In the case of a joint bid, a power of attorney from the joint bidders must be attached.
