Compliance requirements
The bidder must be excluded from the procurement procedure if any statutory exclusion ground applies to it or to a member of its management body, a procurator or another person authorised to represent it. These include participation in a criminal organisation, corruption, fraud, terrorism or financing of terrorism, illegal use of labour, offences related to child labour or trafficking in human beings, tax, fee or environmental charge arrears, and breach of international or government sanctions. The bidder must confirm that none of these grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment, if this is required under the law of that country, and must provide evidence of registration if it is not an Estonian bidder. The bidder and/or its subcontractor must have completed at least one contract similar to the subject matter of the tender within the 60 months before the start of the procurement, with a total value of at least EUR 15,000, relating to construction and/or repair works. A list of contracts must be submitted with information on value, dates and contracting parties. There must be a qualified responsible person for the works, including a construction works manager holding the professional certificate “Construction Works Manager, level 5” or equivalent or better. The bidder must submit a list of responsible persons and copies of documents proving their competence; a foreign bidder may submit equivalent documents from its country of establishment and later, within one month after signing the contract, a confirmation issued by the Consumer Protection and Technical Regulatory Authority.
