Compliance requirements
The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted in the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour or other forms of human trafficking, participation in a criminal organisation, or offences related to committing a terrorist act or terrorist activity. It must also confirm that there are no other exclusion grounds set out in the tender documents. If any exclusion ground applies, the company may submit evidence of self-cleaning measures, if permitted. For first-tier subcontractors, the same criminal exclusion grounds are checked during contract performance; second-tier and subsequent subcontractors are not checked.
Qualification criteria and exclusion grounds
The bidder must prove previous experience: within the last 60 calendar months, it must have designed and built at least one youth centre, library or other similar public building with a closed net floor area of at least 200 m2. Similar objects also include kindergartens, school buildings, social buildings and other public buildings. The design and the construction works do not have to have been performed under the same contract. A summary of the reference must be provided in the ESPD, together with the contact details of the previous clients; the contracting authority may ask for confirmation that the works were performed properly. If the reference was carried out outside Estonia, a certificate or confirmation letter must be added showing the content, scope, period and proper performance of the works. The bidder must also have a key person who has participated as a key person in the performance of at least one similar design-and-build contract. The exact role and qualification requirement for the design stage was not fully visible in the machine-readable notice; it must be checked in the tender documents. The bid must comply with all tender document requirements, conditional bids are not allowed. The bid price structure must also be completed as required, and equivalence must be demonstrated where necessary.
