Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Estonian Public Procurement Act apply. These include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, illegal employment of foreign workers or breach of foreign workers’ employment conditions, illegal use of child labour or human trafficking, tax debts, and breaches of international or Government sanctions. The bidder must confirm that none of these grounds apply to it.
Qualification criteria and exclusion grounds
The bidder, a joint bidder and/or its subcontractor must have performed at least one contract similar to the subject of the tender within the last 60 months before the start of the procurement. A list of similar contracts must be submitted, including the contract value, dates and the other contracting parties. If the bidder relies on a subcontractor’s reference, the subcontractor must be added to the subcontractor table so that the contracting authority can also check the subcontractor’s exclusion grounds. For the bid price, the bidder must complete the bid price form in Excel according to the specified structure.
