Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption and fraud. For these grounds, the bidder must confirm that neither it nor its management, representation or supervisory body members have been subject to relevant final convictions in the last five years, or that the exclusion period no longer applies. If any ground exists, the bidder may submit evidence of self-cleaning measures where permitted. Where evidence is available electronically, a URL, code and issuer may need to be provided. The machine-readable notice may contain other exclusion grounds as well, but the exact list must be checked in the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents. According to the compliance requirements, the bidder must provide the manufacturer’s technical description or documentation for the offered products so that compliance with the requirements can be assessed, and must confirm that the bid complies with the tender documents. If the bid is a joint bid, a power of attorney for the joint bidders must be attached. If an equivalent solution is offered, it must be explained where necessary and evidence of equivalence must be included. The bidder must also confirm that the engine manufacturer has at least 3 years of experience in outboard engine production, an active authorised service network in the European Union, and guaranteed availability of spare parts and maintenance in the EU. In addition, the bid price must be submitted in the required structure, and by submitting the bid the bidder confirms acceptance of all tender document conditions; conditional bids are not allowed.
