Compliance requirements
The machine-readable notice included exclusion grounds based on criminal convictions, including participation in a criminal organisation, corruption, fraud and other standard grounds under the procurement rules. The bidder must confirm that none of the exclusion grounds apply to it or to the relevant persons acting for it. If an exclusion ground exists, self-cleaning measures may be presented where allowed by the tender documents or the applicable rules. The notice also includes restrictions related to bidders established in Russia or Belarus and sanctions-related restrictions on certain subcontractors, suppliers and supporting entities.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. For the Estonian commercial register, the contracting authority checks this itself.
The bidder’s average annual net turnover for construction works of water supply and sewerage facilities over the last three completed financial years must be at least EUR 500,000 per year. Form 4 on turnover must be submitted.
Within the 36 months before the start of the procurement, the bidder must have completed at least one project for the construction of water supply and sewerage pipelines, with at least 1 km of such pipelines built within that project. A short description of the contracts, the performance period, the other contracting party’s details and, in the case of a public procurement, the reference numbers must be provided. On the contracting authority’s request, evidence of proper performance must be submitted.
If the bidder relies on the capacities of other entities, an ESPD for those entities must also be submitted and they must not have exclusion grounds.
When submitting the tender, the required forms must be completed, including the joint tenderers’ power of attorney, the tender notice form and the price list. Conditional tenders are not allowed. The tender must comply with the procurement documents and, where necessary, equivalent solutions must be explained and evidence of equivalence must be attached.
