Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorism-related offence, money laundering or terrorist financing. Exclusion also applies if such a person has been convicted of enabling the employment of a foreign national staying illegally in the country or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum wage, or of illegal use of child labour or trafficking in human beings. A bidder is also excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may exclude a bidder if it has seriously or persistently breached essential terms of a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were compensated or a contractual penalty was paid, or if it has provided false information about compliance with qualification requirements or failed to submit the required information and documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting parties, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. On request by the contracting authority, evidence of proper performance of the similar electrical construction contracts must be provided, unless the authority can obtain the information from public or private databases without significant cost. In addition, the bidder must have a person responsible for electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act; this person must have the relevant certificate at the time of submission of tenders and must be added to the EPP environment before tenders are opened. The bidder must also provide the names and contact details of the contract signatory and the contact person for contract performance; if the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The bid must include a price table in the form required by the tender documents, and all unit price fields must be completed. The bid must comply with all conditions set out in the tender documents.
