Compliance requirements
Mandatory exclusion grounds: the bidder is excluded if it or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control it has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing; if it has been convicted of enabling the employment of an illegally staying foreign national or violating the conditions for employing a foreign national in Estonia; if it has been convicted of illegal use of child labour or trafficking in human beings; or if it has tax, fee, environmental charge or social security contribution arrears.
Voluntary exclusion grounds: the bidder may be excluded if it has seriously or persistently breached an essential term of a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was imposed; or if it has provided false information about compliance with the selection criteria or failed to submit the required information or documents.
The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus. It must also confirm that the materials, equipment and goods used in the works, including components, are not produced in or originating from the Russian Federation or the Republic of Belarus. The contracting authority may request certificates of origin.
In the case of a joint tender, a authorised representative must be appointed and a joint bidders’ power of attorney must be submitted.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance.
The bidder’s team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the deadline for submitting tenders. If only low-voltage works 0.22–1 kV are procured, at least low-voltage switching authorisations are sufficient; in other cases, both low-voltage and medium-voltage switching authorisations are required.
The bidder must have a person designated as responsible for the work operation, and that person must be entered into Elektrilevi’s partner portal before the deadline for submitting tenders.
The bidder’s team must include a lead electrical worker with valid A-competence or, within the meaning of the Vocational Education Act, at least level 6 qualification, who has the relevant proof at the time of submitting the tender and who has been added to Elektrilevi’s partner portal before the deadline for submitting tenders.
The bidder must provide the names, job titles and contact details of the person(s) signing the contract and the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included.
The tender must include the price table in accordance with the form in the tender documents, and all unit price fields must be completed.
