Compliance requirements
Mandatory exclusion grounds relate to convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or other terrorist activity, money laundering or financing of terrorism; also to offences related to unlawful employment of foreigners, illegal use of child labour or human trafficking, and to debts for state taxes, charges or environmental fees. The bidder may also be excluded if it has seriously or repeatedly breached essential terms of a previous contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was imposed, or if it has submitted false information about meeting qualification requirements or failed to provide the required data and documents. The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
Over the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, details of the other contracting party (including the client representative’s contact details, phone number and email address), and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided unless the authority can obtain the information from public or its own databases without major expense. In addition, the team must include a person with valid switching authorisations entered in Elektrilevi’s partner portal before the bid submission deadline, and a person responsible for the work operation who is also entered in EPP before the deadline. The team must also include a leading electrical works person with valid A-competence or, under the Occupational Qualifications Act, at least level 6 qualification, who has the relevant proof at the time of bid submission and is entered in the partner portal before the deadline. The bidder must provide the names and contact details of the signatory(ies) and the contact person; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include the price table in the prescribed form and all unit price fields must be completed. If this is a joint bid, the joint bidders’ power of attorney must be attached. The machine-readable notice did not include any additional precise qualification or compliance requirements beyond the above; the rest must be checked in the tender documents.
