Compliance requirements
The bidder must confirm that none of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply to it. These include, among other things, convictions for certain crimes, offences related to enabling illegal work by a foreign national, offences involving child labour or human trafficking, tax or social security debt, and breach of sanctions. If any of these grounds apply, the bidder is excluded from the procurement procedure.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority will check the data itself; a foreign bidder must submit a copy of a valid registration certificate.
The bidder and/or its subcontractor must have performed at least 1 contract similar to the subject of the procurement within the last 5 years before the start of the procurement. The bidder must submit a list of the most important contracts performed during the last five years, including their value, dates and the other contracting parties, using the form “List of contracts”, together with confirmation that the contracts were performed properly.
The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works, including a person leading electrical works who has at least a class B competence certificate or an equivalent or better qualification. Copies of documents proving the qualifications and competence of the responsible persons must be submitted. A foreign bidder that does not have such documents issued in Estonia must submit copies of the documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the qualification and competence of the above-mentioned responsible person.
