Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Estonian Public Procurement Act apply to it. These include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, illegal employment of foreign nationals, illegal use of child labour, human trafficking, tax debt, and breaches of international sanctions or sanctions imposed by the Estonian Government. If any of these grounds apply, the contracting authority will exclude the bidder from the procedure.
Qualification criteria and exclusion grounds
The bidder must have properly performed, within the 60 months before the start of the tender, at least one contract similar to the subject of the procurement, under which railway construction and/or major overhaul works were carried out on a station and/or interstation railway track, including embankment and ballast installation, over an aggregate length of at least 1,000 metres. The works must have been accepted and there must have been no material breaches. A list of the relevant contracts must be submitted, including the scope of works, dates, the other contracting parties and, where applicable, the public procurement reference number. The bidder’s site manager must hold the professional qualification “Railway track mechanic”, at least level 4, and a copy of the certificate must be submitted with the tender documents. The bidder’s workers, at least 2 persons, must hold the qualification “Assistant railway track mechanic”, at least level 2, and copies of the certificates must be submitted with the tender. In addition, the bidder must submit a list of the equipment to be used in contract performance with its main parameters, a short description of the work technology process, and, if applicable, a copy of a valid ISO 14001 environmental management system certificate or an equivalent certificate, or confirmation from an independent audit firm/accredited certifier. If the bidder does not apply a systematic environmental management approach, an appropriate declaration must be provided. The tender must comply with the tender documents, and conditional tenders are not allowed.
